Terms of Use for the Literary Portal

1. General Provisions

1.1. These terms of use (hereinafter referred to as "Terms") govern the rights and obligations between the operator of the internet portal "citaj.zaujimave.info/publikuj.zaujimave.info" (hereinafter referred to as "Portal") and its users.

1.2. The operator of the Portal is an individual at triblax(@)gmail(.)com (hereinafter referred to as "Operator").

1.3. A user is defined as any individual who visits the Portal (hereinafter referred to as "Visitor") or registers on the Portal for the purpose of publishing their own work (hereinafter referred to as "Author").

2. Registration and User Account

2.1. Registration is required for publishing your own work on the Portal.

2.2. By registering, the Author confirms that they:

  • have reached the age of 18
  • agree to these Terms
  • all information provided during registration is true and complete

2.3. The Operator reserves the right to cancel a user account at any time without giving a reason and without any entitlement to compensation.

3. Publishing Content

3.1. The Author may publish their own literary works, short stories, books, and articles (hereinafter referred to as "Works") on the Portal.

3.2. The Author undertakes that:

  • they are the sole and exclusive author of the published Works
  • the Works do not infringe copyright or other rights of third parties
  • the Works do not contain plagiarism or represent copying of someone else's work
  • the content of the Works complies with the legal system of the Slovak Republic and the European Union

3.3. In the case of publishing Works with erotic content, the Author is obliged to:

  • mark such Works as "18+" in the appropriate category
  • ensure that the content does not violate the law (especially §371-374 of the Criminal Code)
  • not include content that could be classified as pornography

4. Copyright and Licenses

4.1. By publishing a Work on the Portal, the Author grants the Operator a free, non-exclusive, temporally and territorially unlimited license to:

  • display the Work on the Portal
  • technically process the Work as necessary for its display
  • archive the Work
  • remove the Work from the Portal

4.2. The Author is not entitled to any remuneration or other form of compensation for publishing Works on the Portal.

4.3. The Operator has the right to remove any Work from the Portal at any time without giving a reason and without any entitlement to compensation.

5. Liability for Breach of Terms

5.1. In the event of copyright infringement or violation of other provisions of these Terms, the Author undertakes to:

  • compensate the Operator for all damages incurred
  • pay all costs associated with legal representation
  • pay all court and out-of-court fees
  • pay a contractual penalty of 5000 EUR for each individual violation

5.2. The Operator reserves the right to:

  • immediately remove disputed content
  • block the Author's user account
  • inform the relevant authorities about illegal activities
  • seek compensation for damages through legal action

6. Protection of Personal Data

6.1. The Operator processes personal data in accordance with the GDPR Regulation and Act No. 18/2018 Coll. on the protection of personal data.

6.2. Detailed information on the processing of personal data is provided in a separate document "Privacy Policy".

7. Final Provisions

7.1. These Terms come into force and effect on the day of their publication.

7.2. The Operator reserves the right to unilaterally change these Terms at any time.

7.3. All disputes arising from these Terms will be resolved by the competent courts of the Slovak Republic.

7.4. If any provision of these Terms becomes invalid or ineffective, it does not affect the validity and effectiveness of the remaining provisions.

Additional Information to Explain to Authors - When Text Can Be Considered Pornographic (and is Prohibited)

Based on Slovak legislation and case law, I will explain the criteria for designating text as pornographic: Text can be considered pornographic if it meets these criteria:

It goes beyond eroticism - while eroticism portrays sexuality in an artistic, aesthetic, or sensitive manner, pornography is an explicit depiction of sexual acts with the dominant aim of provoking sexual arousal. The main purpose is sexual stimulation - the text focuses exclusively or predominantly on detailed descriptions of sexual acts without a broader narrative or artistic context. It contains vulgarisms - excessive use of vulgar terms for genitals and sexual activities. It lacks artistic/literary value - absence of story, character development, theme, or message beyond sexual content. It dehumanizes characters - reduces people to merely sexual objects without personality and character.

Erotic text (allowed) vs. pornographic text (prohibited): Erotic text (allowed):

Contains sexual scenes as part of a broader story Uses literary devices and metaphors Has artistic/literary value Characters have character and story Sexuality is a natural part of the plot

Pornographic text (prohibited):

Focused exclusively on detailed descriptions of sexual acts Uses vulgar expressions Without story and artistic value Characters are only sexual objects The sole purpose is sexual stimulation

In case of doubt, it is appropriate to mark the text as "18+" and leave the assessment of borderline cases to the moderators of the portal.
